Efforts on to enforce model code of conduct strictly for Thiksey by-election

With the announcement of by-election of the Thiksey constituency to be held on June 4, Avny Lavasa, DC issued the model code of conduct on May 3 in Leh. Several measures are being put in place to ensure it is not violated by political parties, candidates, and bureaucrats. 

It is mandatory for all political parties and independent candidates to follow the model code of conduct in letter and spirit till the election process is over. The enforcement of the model code of conduct has to vitiate the entire election process and immediate steps are required to check this unhealthy practice.

Under section 144 of the Jammu and Kashmir criminal Procedure code, Avny Lavasa orders:

 

•   No rallies/Public meeting of a political nature shall be permitted in the constituency without proper permission. The permission order has to be produced on demand during the inspection by government servants like magistrates and police officers /personnel at the venue of the rally/public meeting.

 

•    No vehicles shall be used for electioneering/campaigning/loud announcements without proper permission, which shall be displayed on the windshields of the four-wheeler vehicles in a way visible to all concerned. In case of two-wheelers, such permission need not be displayed but should be produced on demand for inspection.

 

•    Public premises and government structures like government buildings, electric poles, road dividers etc. shall not be defaced by poster, flags and private structure shall be used only with the prior consent of the owners.

 

•    Non-bio-degradable material like plastic, polythene etc. shall not be used for any kind of electioneering/campaigning activities.

 

•    Loud announcements shall not be carried out without permission and in any case in the vicinity of school, hospitals and old age homes. In any case, no such announcements shall be carried out before 10:00 am in the morning and 6:00 pm in the evening.

 

•    Liquor, cash (even paltry amounts), food and consumer goods shall not be distributed by any organisation without prior information to this office. This applies to Non-Governmental Organizations also.

 

•    The registered/Licensed liquor shops shall inform the excise and police authorities on their daily sales of liquor and especially bulk sales be brought immediately to the notice of the authorities. The district excise officer with the assistance of the police shall take legal action against all unregistered /unlicensed bars/liquor shops immediately and report on action taken within a week of the issue of the order.

 



The order shall be in force in the 14- Thiksay constituency till the by-election is over and enforced in letter and spirit by all magistrates and the police department. They shall have the authority to seize any vehicle and stop any rally/procession if it is found that they are in contravention of the order or to the MCC. 

The superintendent of police, Leh shall take necessary steps at her own level to enforce this order.
