DM, Leh, issues order for relaxations effective April 20
With the continuation of lockdown measures to May 3, for the containment of COVID-19 epidemic in the country, selected additional activities will be allowed but with conditions with effect from April 20.
Sachin Kumar Vaishya, Chairman, District Disaster Management Authority/District Magistrate, Leh has issued an order on April 19, regarding the relaxations in the lockdown measures from 20th April 2020 as per the GoI order. The order reads as:
1. Whereas, the Government of India order dated 24.03.2020 read with order of even number dated 15.04.2020, has notified measure for lockdown all over the country w.e.f 25th March, 2020, till 3rd May, 2020; and
2. Whereas, accordingly, the undersigned as the Chairperson of District Disaster Management Authority, Leh had issued orders for enforcing lockdown in their respective districts since 25th March, 2020 to be in force till 3rd May, 2020; and
3. Whereas, consequent upon Government of India’s decision to allow some select additional activities, it has been felt necessary to lay down certain instructions/ Standard Operating Procedure (SOP) to facilitate the functioning of these activities while observing norms of social distancing.
4. Now, therefore, in the exercise of powers conferred upon me, in my capacity as the Chairperson of District Disaster Management Authority, under Section 34 of the Disaster Management Act, 2005, the instructions annexed with this order are notified which can be carried out from 20th April, 2020.
Following permitted activities shall be allowed with effect from April 20, 2020.
1. All health services (including Ayush) will remain functional.
2. Agricultural and horticultural activities to remain fully functional; operation of mandis and Custom Hiring Centres (CHC) related to farm machinery. Shops of agricultural machinery, its spare parts and repairs to remain open. Fisheries, dairy sector, animal husbandry will be functional.
3. Banks and ATMs will remain functional.
4. Homes for children/disabled/mentally challenged/ senior citizens/ destitute/ women/ widows remain functional. Anganwadis will remain functional for the distribution of food items and nutrition once in 15 days at the doorsteps of beneficiaries.
5. All educational, training, coaching institutions etc. shall remain closed.
6. MNREGA works will be allowed with strict implementation of social distancing and face mask; priority to be given for construction of irrigation and water conservation works.
7. Operation of utilities in water, sanitation and waste management sectors (Tsangda) at municipal/ local body levels.
8. All goods traffic will be allowed to ply with driver and a helper subject to the driver carrying a valid driving license (No permit shall be needed for the trucks to ply, however; there shall not be any misuse of the permit).
9. Supply of essential goods is allowed, and the facility of home delivery service initiated by the District Administration Leh is encouraging people to stay inside and minimize their movement outside their homes.
10. Services provided by self-employed persons such as plumbers, electricians, IT repairs, motor mechanics, and carpenters will be allowed to operate.
11. Industries operating in rural areas i.e. outside the limits of municipal corporations and municipalities will be allowed to operate. Food processing, and brick making is allowed with strict application of advisory of social distancing.
12. Construction of roads, irrigation khuls, buildings and all kinds of industrial projects in rural areas; construction of renewable energy projects by NHPC, LREDA or any authorised agency. While the concerned Executive Engineer shall abide by the guideline/SOP laid for resumption of construction activities during the lockdown period by the construction departments.
13. Private vehicles for emergency services including medical and veterinary care, and for procuring essential commodities. In such cases, one passenger besides the private vehicle driver can be permitted in the backseat.
14. Offices of State/Union Territory Governments, their Autonomous bodies and Local Governments; offices such as Defence, Central Armed Police Forces, Health and Family Welfare, Disaster Management and Early Warning Agencies (IMD, INCOIS, SASE and National Centre of Seismology, CWC), National Informatics Centre (NIC), Food Corporation of India (FCI), NCC, Nehru Yuva Kendras (NYKs), police, home guards, civil defence, fire and emergency services, disaster management, prisons and municipal services will function without any restrictions.
All other departments of State Governments/District administration to work with restricted staff.
15. All such persons who have been directed by health care personnel to remain under strict home/institutional quarantine for a period as decided by local Health Authorities are required t remain under mandatory quarantine.
However, these relaxations shall not be applicable in the Containment Zones/ Red Zones/ Hot spots etc. notified within the district, Leh.
To implement these containment measures, Sub-divisional Magistrates will ensure their implementation in their Subdivisions. All other line department officials in the specified area will work under the directions of SDMs.
Any person violating these lockdown measures will be liable to be proceeded against as per the provisions of Section 51 to 60 of the Disaster Management Act, 2005, besides legal action under Sec. 188 of the IPC, and other legal provisions as applicable.
